Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand. 


This update is provided on a weekly basis.


LEGISLATION CHANGES

Aged Care Legislation Amendment (Basic Subsidy Amount - COVID-19 Support) Determination 2020

  • Amends the Aged Care (Subsidy, Fees and Payments) Determination 2014 and the Aged Care (Transitional Provisions) (Subsidy and Other Measures) Determination 2014 so that aged care subsidy for care recipients on extended hospital leave will not be reduced during the period 1 July 2020 to 30 June 2021.


Liquor (COVID-19 Emergency Response - Licence Fee Waiver) Declaration 2021 (No 1)

  • Outlines the fees waived by the commissioner under Section 35 of the Liquor Regulation 2010 and the Liquor (Fees) Determination 2020 (No 2).

Public Health (COVID-19 Affected Areas) Emergency Direction 2021 (No 4)

  • Directs affected persons (people who have been in a COVID-19 affected area or their close contacts) to quarantine and complete a self-declaration form as specified in the direction and prohibits affected persons who are not ACT residents from entering the ACT.

Public Health (COVID-19 Affected Areas) Notice 2021 (No 4)

  • Identifies multiple places in the State of Victoria as COVID-19 affected areas.


Public Health (COVID-19 Interstate Travellers) Amendment Order 2021

  • Enables the Chief Health Officer to identify places outside NSW as places of concern.

Public Health (COVID-19 Mandatory Face Coverings) Amendment (No 4) Order 2021

  • Amends the Public Health (COVID-19 Mandatory Face Coverings) Order 2021 to remove the requirement for persons to wear fitted face coverings unless on public transport or in public transport waiting areas in Greater Sydney, and in airports and on aircrafts in NSW.

Public Health (COVID-19 Restrictions on Gathering and Movement) Order (No 7) Amendment (No 6) Order 2021

  • Amends the Public Health (COVID-19 Restrictions on Gathering and Movement) Order (No 7) 2020 to remove certain restrictions applying to gatherings in Greater Sydney.



Declared Hotspots Direction

  • Identifies COVID-19 hotspots for the Public Health Direction - Border Restrictions Direction (No. 22), including 36 Victoria Local Government Areas.


Emergency Management (Cross Border Travel No 38) (COVID-19) Direction 2021

  • Prohibits persons who have been in Victoria or a prohibited location from arriving in South Australia, requires restricted location arrivals and overseas arrivals to undergo COVID-19 testing and quarantine, prohibits restricted location arrivals from attending certain events, and requires restricted location arrivals to wear masks in public until a negative COVID-19 result is received, among other things.

Emergency Management (Quarantine and Testing of Certain Former Victorian Arrivals No 4) (COVID-19) Direction 2021

  • Requires all restricted former Victorian arrivals  to submit to a COVID-19 test and for certain arrivals to quarantine.

Emergency Management (Residential Aged Care Facilities No 30) (COVID-19) Direction 2021

  • Prohibits the entry of persons into residential aged care facilities except in certain circumstances, limits the provision of personal care by personal care workers to one facility, requires certain persons to undertake COVID-19 infection control training, requires certain records to be kept, and requires such facilities to adopt a Workforce Management Plan and COVID-19 Infection Control Plan, among other things.


Direction Under Section 16 - Arrival Requirements for Certain Travellers into Tasmania - No.5

  • Requires relevant travellers arriving in Tasmania to undergo certain clinical assessments and COVID-19 testing.


Care Facilities Directions (No 21)

  • Prohibits non-essential visits and access to care facilities to limit the spread of COVID-19 within a particularly vulnerable population - came into force at 11.59 pm on 12 February 2021.

Hospital Visitor Directions (No 19)

  • Prohibits non-essential visits and access to hospitals to limit the spread of COVID-19 hospitals - came into force at 11.59 pm on 12 February 2021.

Restricted Activity Directions (Victoria) (No 7)

  • Restricts the operation of certain businesses and undertakings in Victoria to address the serious public health risk posed by COVID-19 - came into force at 11.59 pm 12 February 2021.

Stay Safe Directions (Victoria) (No. 14)

  • Requires people who ordinarily reside in Victoria to limit their interaction with others by restricting circumstances in which people may leave their home, prohibiting visitors at persons' homes, restricting gatherings and requiring face coverings - came into force at 11.59 pm on 12 February 2021.

Workplace Directions (No 19)

  • Limits the number of Victorians attending Work Premises to assist in reducing the frequency and scale of COVID-19 outbreaks in Victorian workplaces and to establish more specific obligations on employers and workers in relation to managing the risk associated with COVID-19 - came into force at 11.59 pm on 12 February 2021.


Chief Health Officer Approval to Request COVID-19 Testing on Persons who are Presenting to be Tested Under the Presentation for Testing Directions (No. 16)

  • Gives approval to medical practitioners and persons engaged to collect specimens at a COVID Clinic to request a COVID-19 test as an approved requester, in respect of any person that the requester has been reasonably satisfied is a person required to present to the COVID Clinic to comply with certain requirements under the Presentation for Testing Directions (No. 16).

Chief Health Officer Approval to Request COVID-19 Testing on Persons who are Presenting to be Tested  Under the Presentation for Testing (Quarantine Centre Workers) Directions (No 5)

  • Gives approval to medical practitioners and persons engaged to collect specimens at a COVID Clinic to request a COVID-19 test as an approved requester, in respect of any person that the requester has been reasonably satisfied is a person required to present to the COVID Clinic for the purpose of complying with certain protocols under the Presentation for Testing (Quarantine Centre Workers) Directions (No 5).

Controlled Border for Western Australia Amendment Directions (No 13)

  • Amends the Controlled Border for Western Australia Directions and requires a person, other than an international arrival, who has been in Victoria after 12.01 am on 3 February 2021, and in the 14 days before the person enters Western Australia, to comply with the Victorian Outbreak Response Directions (No 2).

Extension of Declaration (No. 2) of Public Health State of Emergency

  • Extends the public health state of emergency declaration which commenced on 23 March 2020 for fourteen days.

Extension of State of Emergency Declaration

  • Extends the state of emergency declared on 15 March 2020 for a further 14 days.

Health Services (Health Service Providers) Amendment Order 2021

  • Declares the provision and distribution on a statewide basis of vaccines for COVID-19 to persons to be health service areas, among other things.

Presentation for Testing Directions (No 16)

  • Requires certain travellers to undergo testing and temperature checks.

Presentation for Testing (Quarantine Centre Workers) Directions (No 5)

  • Requires quarantine centre workers to comply with the seven day presentation protocol on an ongoing basis for the specified period, and the shift presentation protocol.


COVID-19 Public Health Response (Alert Level Requirements) Order 2021

  • Requires workplaces and public transport services to display a QR code in a prominent place, workplaces to keep contact tracing records, every person on public transport or on domestic air transport services to wear a face covering, physical distancing, and persons in alert level 3 areas to stay at home except in certain circumstances, and restricts travel between certain alert level areas, prohibits outdoor gatherings in alert level 3 areas, sets out requirements for certain workplaces, adjusts requirements for certain businesses, services, education entities, public transport services and workplaces in level 2 areas, and restricts social gatherings.

COVID-19 Vaccine Eligibility Direction 2021

  • Specifies the persons who are eligible to receive publicly funded COVID-19 vaccination.

Determination of New Organisms

  • Determines that the SARS-CoV-2 vaccine BNT162B2 (COMIRNATYTM) is not a new organism for the purpose of the Hazardous Substances and New Organisms Act 1996.
